Angie'sList or Angie'sBust? You Decide!

Message Sent To Angie'sList On January 23, 2014:

I'm looking at a contractor I reviewed (poorly) a few months ago, Terravest Custom Homes, yet my MEMBER review does not appear while two "A" reviews from 2012 do! This is not the first time this has happened and is telling about the honesty and/or accuracy of the service I am paying you for. You can read more about my concerns with Angie's List on www.InstitutionalTerrorism.com.

I have had nothing but trouble with Angie'sList since day one. I gave up a previous account in Kansas City due to their underhanded techniques and favorable treatment of the contractors and service-providers they are supposed to provide "objective and unbiased" reviews of.

I found that my negative Angie'sList reviews were magically not appearing on the pages of companies with "apparently" PERFECT RATINGS. I also filed a dispute with Angie's List against Ryan lawn and Tree (Kansas City, MO) after my home was damaged to the tune of nearly $1,000 by squirrels Ryan's inadequate tree-triming failed to alleviate as promised. Ryan failed to trim trees and in one case trimmed a healthy tree that was not part of the estimate, causing damage to the tree.

As is the case with all Angie'sList reviews, IF A NEGATIVE REVIEW APPEARS AT ALL, the contractor/service-provider always has the final say and, as was the case with both Ryan and Terravest, they lied through their teeth, leaving readers with a false impression that the consumer, me, was wrong.

The only reason I paid for an Angie'sList subscription after moving to Lawrence, Kansas was because of the unethical contractor, Terravest Custom Homes, and so I could submit an unbiased review to help other consumers avoid wasting time and money as I had done. In the end, the two times I logged-in and checked the review in question, it was not posted and did not figure into the grade as was the case in the video recorded today and presented here.

Here is the review in question:

Description Of Work: We asked for an estimate to build a double garage on our lot.

Angie'sList Member Comments:

"We contacted J. Stewart, the owner of Terravest Custom Homes, LLC, about building a two car garage BEFORE winter. We budgeted $20,000 plus or minus 10 percent for the project, being prepared to pay $18,000 to $22,000 in cash. Mr. Stewart seemed like a nice person when he came to do the estimate, seeming willing to work with us. We told him what our budget was and what exactly we wanted, a simple 24 foot by 24 foot two car garage on a cement slab with a double door, one window, one door, and electricity. We also wanted a quote to install a sidewalk from the garage to the front door. Mr. Stewart told us that he would try to keep costs down and estimated $30 to $40 a square foot for what we wanted, bringing the total to between $17,250 and $23,000 and very close to our budgeted amount. He told us that he could not provide a "final" quote until we had plans drawn up, so he recommended an architect whom we met with the following week.

When Mr. Stewart and the architect came to the house, we went through the process again, spelling out exactly where the garage would go, the size, and other details in order for the architect to draw up the plans to submit to the city. He told me that it would cost $600 to $1000 to complete the work and, trusting Mr. Stewart, we decided to go ahead with the plans in order to finish the garage before winter. That was on September 11th, 2013. The architect said that he should be able to finish the plans in a week.

A month went by with no word from either Stewart or the architect, so I contacted both and asked what the delay was. The architect said that it was taking longer than expected and that he would go to the city to see if there were any restrictions as well as come back to the house to measure the house, lot, and other things necessary to finish the plans. We finally received the plans on October 17th, 36 days after we were promised they would be done in one week. Winter was quickly approaching and we wanted to get the project going ASAP.

With plans in hand, Mr. Stewart scheduled an appointment to come by with his quote on Friday, October 17th, he was about 30 minutes late. As I looked over the quote, I was drawn to the total which was well over $30,000, FAR ABOVE the $30 to $40 a square foot we were quoted ($30,500 divided by 575 square feet comes to over $53 a square foot). I told Mr. Stewart that we could not afford $30,000 and he said "I can suggest some metal building companies", to which we replied "we already have a quote and it is only $6,000 for a metal garage". He quickly left without saying another word or offering to make things right.

I am disappointed by his behavior, making us wait nearly six weeks then coming in $10,000 (a 50 percent increase over his estimated price) over his original quote, but I am more upset with myself for trusting the man. We now have no garage, winter weather will arrive in a few weeks, and we spent $600 we could not afford to have plans drawn for a garage that may never be built. I should have known better than to trust a human being after what we have been through in the last 5 years, but J. Stewart seemed like a nice man with integrity, so I thought he would do the right thing. He did not, so DO NOT BE FOOLED by his friendly demeanor and empty promises. We paid and are still paying for trusting J. Stewart and Terravest Custom Homes, LLC, so we believe you should proceed very cautiously before hiring him for any project, particularly one with tens of thousands of dollars on the line."

Company (Terravest) Response:

"I am very sorry that the Angie's List Customer was dissatisfied with my presentation. I had as well hoped the project would have priced out at a lower price as we had hoped but the facts are not stated correctly. Several costs were presented as allowances which the client could opt not to spend. For example, we priced a $350 walk-in door with two small windows in the upper portion of the door to allow light into the garage while maintaining security and a window was added on the side of the building which again we gave the client the ability to deduct theses additional expenses. A standard 6 panel door could be selected for less expense and the window could have been deleted. When it was evident that the price was just to high for the clients we did discuss the metal building because I wanted to help them get some structure that could be affordable for them, I was willing to recommend a competitor just to still help them get a structure done before winter hit. The price they are quoting they got from someone was the metal building only with no foundation. We were asked to provide a concrete foundation, a garage concrete approach to the garage and then we were called back and asked to include 30 feet of sidewalk and an option to run more concrete to the front of the house. The person who is writing the review I have never been introduced to and dont know if I ever even met. There was a woman who showed up at the same time I did to present my presentation that I was thirty minutes late for but I had contacted the client in advance to let them know I was running behind on my schedule. The garage was also bid with other upgrades, a Heritage type 3-D roof versus a 3 tab, electrical wiring and a lighting allowance was added and a insulated garage door with an opener all which could be deducted or down graded. For example the garage door was an insulated door being installed on an un-insulated garage but this was included on the thought that the client would eventually insulate the garage. When we notified the client that we had all the bids together and we were assembling the bid we were also asked to include regrading the drainage on the lot which was also included. The cost of the city building permits were also added to the actual cost of the garage. The architectural drawings were suggested because there was a historical concern mentioned and more importantly it was explained to the client that the client would own the plans and they could therefore use the plan to get alternative bids from other contractors if I was unable to meet their budget expectations. Because the client worked directly with the architect, I was unaware of the delay in getting the drawings and I should have checked on this and did so the minute the client called me with concerns of delays and I did get the proposal to the client within ten days of receiving the blue prints as I had originally promised. When the client called and asked for additional drainage work around the garage, it was also determined that the sewer line for the house ran under the foundation for the garage and additional steps to taken to remedy any this problem as well is the removal of the line of trees along the alleyway and the pad that needed to be built up so that we could correct the rest of the drainage issues for the client. We even included an allowance of $250 for fine grading and seeding of the rear lot after the work was completed. Leaving in the cost of regrading the lot and removal of the trees but removing the additional upgrades the cost would have been at $48 per foot which was still too high for the clients budget and we apologize that we could not meet the expectations of the client but this is why we went through the bidding process to insure the client of what we could do and if the client feels that we have intentionally over priced the project, they own the plans and are free to do the project with another contractor of their choosing and we would be happy to provide any of our bids and estimates to the client or another contractor. We informed the client (a gentleman with a different name than the person submitting the review) before we started the process that it would be extremely hard to meet their budget expectations but we were willing to try if they wanted to have a third party draw the plans to insure that we were bidding apples to apples with anyone else that they choose to have bid the project. We again apologize for any misunderstanding and wish that we would have had the opportunity to involve this person in our discussions about the project and find it very disappointing to have these things written about our company from a person whom we have never met and this is what often happens with third party discussions and it is always good to take notes and ask the contractor to clarify any expectations in writing prior to the start of any project to make sure that everyone's expectations are equal. J. Stewart

Angie'sList Review Addendum (Dated 12/9/2013)

"Very odd, but when I searched Terravest Custom Homes today, my review and grade were nowhere to be found with Terravest receiving an "A" on recent reviews.  I have had this problem with Angie's List before.  Poor reviews are either missing or the service provider lies through their teeth (as is the case again here) and I, the consumer, has little if any recourse to tell the truth.

This account belongs to my wife, Elisa F, "the woman" referred to in the 10/21/13 response, and Mr. Stewart was introduced to her the first time he came to our home and again when he dropped off his ridiculous bid.  Let me just clarify a couple points made by Mr. Stewart in his lengthy, confused, and misleading response (there are so many inaccuracies that I will not attempt to answer them all):

As far as the "grading" and "upgrades" are concerned, Mr. Stewart is lying when he said that they were "added on".  We spoke about the grading ($250), the roof, door, electrical, and roof the first time we met and the second time when the architect came to plan his drawings, so Mr. Stewart's account is intentionally misleading.  The architect can attest to this fact if asked. Even then, we are talking about chump change compared to his overall bid of $30,000. I never called and asked for "additional drainage work", so Mr. Stewart is indeed a liar.  Take that into consideration when deciding whether or not to hire him for a job.

Winter is now here and my wife and I are scraping snow off our cars and freezing our buns off because of Mr. Stewart's incompetence.  Hopefully, Angie's List will DO THE RIGHT THING  and publish my review on Terravest's page so that other consumer's will not waste their valuable time or money.  I am downgrading my review to an "F" because Mr. Stewart is a liar and as a retired AIr Force lieutenant colonel and disabled Veteran, I have ZERO TOLERANCE FOR PEOPLE WITHOUT HONOR AND INTEGRITY ... ZERO!

If You Want to Spend Lots of Money, Take Your Car to Das Autohaus!

DAS AUTOHAUS
1045 New Jersey Street
Lawrence, KS 66044

Phone: 785-843-9494

As is usually the case, I should have listened to my gut instinct before trusting Dave, the owner of Das Autohaus and the Scuba Shack, co-located businesses literally around the corner from our home in Lawrence, Kansas.  When I stopped by to inquire about snorkeling gear for an upcoming trip to the Caribbean and discuss hiring him as our new mechanic (having recently moved to the area), the price for a mask, snorkel, and fins that go for less than $50 (with free shipping) on Amazon.com were quoted at $99 ... HINT #1 that things to come from Dave would not be cheap!

Being unemployed, we do not have a lot of money and our previous mechanic in Kansas City was always honest, fair, and did excellent work. I knew I could trust him and he never took advantage of us, unlike many mechanics, including, in my opinion, Dave and Das Autohaus.

I took our 2000 Volkswagen Beetle to Dave for a simple check of the battery (which was losing its charge on very cold mornings) this morning, expecting a fair and reasonable estimate.  He told me that it would take about an hour to run some diagnostics. I asked him how much an oil change would be while I was there and he told me, "$60".  I told him that my last mechanic only charged me $25 (including oil, filter, checking fluids, and inflating tires) and that I thought his price was too high (HINT #2 of a rip-off ... I should have walked away right then, but I believe in supporting local small businesses), so I told him not to change the oil.

Three hours later, Dave finally called and told me that the problem was in-fact the battery, which I assumed was the case, and considering the fact that batteries for my vehicle run around $100 (including FREE testing and installation) at any reputable auto parts store, I figured it should run me $160 more or less ($100 for the battery and an plus or minus an hour, to be generous, for labor - diagnostics and installation). I asked him how much it was going to cost and he said, "that comes to a little over $280".

I thought maybe I had misheard the price, so I asked him, "did you say $280?". He confirmed the ridiculous price and I said, "I can buy a battery for $100 with free installation at an auto parts store, so why do you want to charge me $280? How much is the battery?".  He replied, "$140", to which I responded, "so you want to charge me $140 in labor to replace a battery I can get installed for free anywhere else?" He told me, "that's what it costs.  Do you know how long it takes to install a battery?"  I told him that I do in-fact know how long it takes because I installed the VW battery 4 years ago myself, taking only about 15 minutes. His "I could care less" and aggressive tone of voice ticked me off, so I told him I would be right over to collect my car.

When I arrived, he insulted me further by saying that the car had not been well maintained and, in an attempt to up-sell someone who was not going to fall for his BS in any event, that I needed to replace the timing belt.  I told him that the timing belt had been replaced less than 70,000 miles ago and that the VW had been well maintained, changing the oil every 5,000 miles even though recommendations are to change diesel oil every 10,000 miles and making all RECOMMENDED and NECESSARY repairs (from our honest mechanic).

He then handed me a bill for $75:

As you can see from the invoice, he not only overcharged me for the labor involved with the estimate, HE CHARGED ME $9.99 FOR SUPPLIES?  What supplies could he have possibly used to test my charging system?

Having spent my Air Force career as a transportation officer and responsible for hundreds of auto mechanics (and the Best Transportation Squadron in the United States Air Force), I know how repair costs are calculated, so I asked Dave how much his hourly rate was. He said, "I work by the job, not by the hour", so I knew he was not on the up-and-up. In comparison, here is a quote from AutoMD.com for the exact repair on my vehicle and as you can see, it is MUCH closer to my estimate than his:

He was trying to charge me over $140 in labor for a job that takes 6/10 of an hour, ATTEMPTING to charge me over $250 an hour for labor when the average is $65 to $70 an hour elsewhere ... CAN YOU SAY "RIP-OFF" ... SURE YOU CAN!

I took my car to Walmart (invoice below) a few days later. They tested my charging system FOR FREE, CHARGED ME ONLY $109.97 FOR THE BATTERY, and INSTALLED IT IN ABOUT 20 MINUTES FOR FREE ... for a total of only $124 and change! Adding in the $75 Dave charged me for doing practically nothing and the grand total came to $200, SO I STILL PAID $80 LESS THAN DAVE WAS GOING TO CHARGE ME even though I should have paid over $150 less if I had been dealing with an honest person.

Mechanics are notorious for taking advantage of uneducated customers as we have all seen on shows like 20/20 and 60 Minutes, but there are good, honest people out there as our last mechanic proved over the last five years. I assumed, and you know what happens when you "ASSUME" ... YOU MAKE AN "ASS" OF "U" AND "ME", that Dave would be fair and honest, knowing very well that this was the first time I had been there and possibly trying to "do the right thing" by a new customer. In my opinion, Dave obviously has no idea what the "right thing" is or what "integrity" entails, so if you have more money than you know what to do with and do not care how much a service costs, by all means go to Das Autohaus! I did not realize how good I had it with our last mechanic, but maybe it is worth the 40 minute drive not to find out how many crook mechanics there are in Lawrence, Kansas!

CombatCritic Gives Das Autohaus 1 Out of 10 Bombs ... Bombs Are Good!

Since this debacle, several people (friends and strangers alike) have come forward with stories of their own about Dave and Das Autohaus. It seems as though he has an unsavory reputation in Lawrence, a reputation I wish I had been aware of prior to trusting him with my car. So I am sharing my story and opinion with you in the hope that I can spare some of my neighbors from a similar experience. Take heed and pass the word along so that others will not be victimized by this unscrupulous business owner.

    UPDATE: 1/27/2014

As usual, AngiesList did not bother letting me know that the owner of Das Autohaus responded to my review, having just read it:

    Company Response:

"This is a false review, we have never worked on a car by a person with the name of [member name removed]. Dave Bach is the only Volkswagen Master Registered Technician in Lawrence. Like any professional, he charges for his work. As a Platinum Pro Diver and Instructor, Dave chooses to sell only quality equipment in his shop."

My response, which AngiesList does not bother to ask for, another sign that they cater to businesses, not consumers, is as follows:

This man obviously has no scruples and will lie at every turn. If you want to see the receipt from Das Autohaus for the "estimate", you can find it at this link: above along with the full review and other documentation proving that what I say is in-fact true and Das Autohaus is lying ... THIS IS NOT A FALSE REVIEW!

I updated the AngiesList review on Das Autohaus with the above information on January 27th, 2014, but whether or not Angie'sList publishes the updated review is a completely different story (as you can read in "AngiesList or AngiesBust ... You Decide!" elsewhere in this blog).

Let Me "Summit" Up: Disrespect, Indignity ... Do Not Let Appearances Fool You!

    The Summit Downtown (Fitness Center)
    901 New Hampshire
    Lawrence, KS 66044
    Phone: 785-856-7979

    Hours: Mon-Thur: 5am - 11pm; Fri: 5am - 9pm; Sat: 7am - 7pm; Sun: 9am - 7pm

A severely disabled Veteran and retired (2005) Air Force lieutenant colonel, I try to take care of the body I am left with after 20 years of austere environments and over 4 years in combat zones (Operations JOINT ENDEAVOR, ALLIED FORCE, SOUTHERN WATCH, AND ENDURING FREEDOM.  I cannot do as much as I used to or as I would like, but the gym is one of the few places I can relax and, beside the golf course, a safe haven where I can cope with the stresses of life. I spent most days of my 20-year career in military gyms and have been a YMCA member for over 10 years, but when we moved to Lawrence, Kansas in August of this year, I was disappointed to find that there was no YMCA in Lawrence. A town of 90,000 and no YMCA?

I bought a Groupon for a 6-week trial at Genesis Fitness for $20, expecting to join if I liked the facility. I did not. The facility was filthy, the sauna never worked, and when I spoke to a manager about joining, he insisted I must pay a $75 “joining fee” and sign a contract for 2-3 years if I wanted their best monthly rate. Hard-sell gym tactics, contracts, and application fees went out with the 20th Century, or so I thought, so I told the man that I would take my business elsewhere. He could have obviously cared less.

I decided to try The Summit, a modern facility in a relatively new building just five blocks from our new Lawrence home (it is actually over 150 years old and a historic home) due to its proximity and a four-month “Fall” special for $150. Not a fantastic bargain ($37.50 per month – I paid less at the Kansas City YMCA which is much nicer, larger, and with many more fitness options). The facility seemed clean and the staff appeared to be friendly and helpful, or so it seemed, so I signed-up for the special (with no initiation fee) with the understanding that I would pay $41.00 per month if I decide to continue.

I liked the facility for the most part, documenting my experiences along the way on Yelp, Foursquare, Facebook, and Twitter. Here are a few:

    The Summit 10/16/2013
“The bench in the men's locker room is wonky and the TV on the first machine didn't work, but it's cleaner than Genesis by a mile!”

    The Summit 10/19/2013
“The only concerns thus far are the saunas, which never seem to be hot enough, and the fans (the kind with blades), which always seem to be on, even on the coldest days. Yesterday was cold (45 degrees) and it was cold inside, but they still had the fans going full blast. When I asked if they could be turned down/off, the young lady behind the counter said "no". Being one of just three customers at the time, I do not think it was an unreasonable request.”

    The Summit 10/24/2013
“I like the proximity and cleanliness, but the fans, sauna, and locker room benches leave MUCH TO BE DESIRED”

    The Summit 10/28/2013
“I spoke to quickly in yesterday's check-in. Fans are going full blast today and it's freezing in here. Yesterday must have been a fluke ... They aren't monitoring social media after all and that's going to cost them that 4th star!”

    The Summit 10/31/2013
“Can't tell if it's chance coincidence or if staff read my comments...today the fans are off and there's a real bench in the locker room...THANKS!”

Having studied diet and exercise extensively over the years for my own benefit and that of my clients (I am a licensed professional counselor specializing in mindfulness-based cognitive behavioral therapy - CBT), I understand the importance of a combination of aerobic activity (running, elliptical, etc.), resistance training (weightlifting), and flexibility (stretching).  I normally use the elliptical machines because they are easy on my knees and back, stretching and meditating afterward to complete my workout.

I had been stretching and meditating most days at The Summit because they had a wonderful thick red mat that was comfortable enough to meet my needs. Because of my disabilities, I find it painful and difficult to use the “Aeromats” (small, individual foam mats) most gyms provide for stretching because they do not provide enough padding, causing discomfort while I lay or sit on the ground.

When I went to stretch the other day, I noticed that the red mat was gone and replaced with mats similar to the Aeromats I dislike so much, so I asked Tanner (an employee) why my favorite mat was removed. He was very kind and helpful, explaining that the mat was worn on the bottom and had been taken away. He explained just yesterday that there was a similar red mat to the one I had been using in the “training” area of the facility and told me that his boss had said that I could use it to stretch if I chose to. I thanked him for his concern and kindness and went about my workout.

After completing my elliptical workout, I noticed that the training area was nearly empty and the red mat was not being used, so I entered to finish my workout with a good stretch and a few minutes of relaxation. As I moved to the mat to sit-down, I noticed one of the trainers (there were more trainers than “trainees”), a blondish 30-something woman with several tattoos on one of her arms, hovering around the area, stalking me like a security guard on a shoplifter. No sooner did I sit-down did she approach me stating, “Who are you working with today”.  I told her “nobody” and she told me that I was “not allowed in the area, it’s for personal training customers only”.  I told her that the owner had said that I could use the area to stretch, as Tanner had told me just a couple hours before, noticing one of the owners standing behind her like a back-up cop waiting to pounce on a criminal. She said, “Oh, you mean him” and I stated I did not know who, but that Tanner had told me just hours before that I had permission. Before I get the words out of my mouth, both she and the co-owner said “this area is for paying personal training customers only” (well excuuuuuuuuuuuuuuuuuuuuse me!) and at that I got up and left the area as ordered!

I believe in treating all with dignity and respect and as a business owner myself, particularly customers.  The Summit apparently does not hold the same values.  I found it extremely embarrassing to be stalked and thrown out of a facility I pay $40 per month to use and in such an unprofessional manner.  I have suffered many indignities at the hands of rude, self-centered people over the years, but never have I experienced such rude, unprofessional, and humiliating behavior in a place of business as I did at The Summit last night.

Now I feel anxious and stressed just thinking about returning to The Summit this afternoon, not knowing how I will be treated.  I am considering asking for a refund of my remaining fees, but there are few fitness options in this college town of nearly 100,000 other than Genesis, The Summit, and the University of Kansas (KU – where I can use their “world-class” facilities for just $20 per month), so I think I will wait until my trial period expires to find a suitable alternative.

My disabilities, including a great deal of pain, and mood are eased by exercise and a clean, safe facility is very important to me.  Except for the filthy air intakes (see photo), The Summit is very clean, but I DO NOT FEEL SAFE any longer.  It pains me that one of my respites, a safe haven in which I can de-stress and take care of a body ravaged by time and combat, the gym, is now a place that causes me stress.

Veterans Day is next Monday, a day on which we show our appreciation for the men and women who have served our great nation.  Instead of feeling appreciated, I feel abused, but then this is not the first time I have been made to feel less than welcome in a public setting in recent years and, I am afraid, it will not be the last … unfortunately.  If you like being treated with INDIGNITY and DISRESPECT, YOU WILL LOVE THE WAY THEY TREAT YOU AT THE SUMMIT IN DOWNTOWN LAWRENCE!

Terravest Custom Homes, LLC - Do Not Be Fooled by the Friendly Demeanor

    J. Stewart and his wife
Terravest Custom Homes, LLC - Do Not Be Fooled by the Friendly Demeanor

We contacted J.

A month went by with no word from either Stewart or the architect, so we contacted both and asked what the delay was. The architect said that it was taking longer than expected (obviously) and that he would go to the city to see if there were any restrictions as well as come back to the house to measure the house, lot, and other things necessary to finish the plans.

As I looked over the quote, I was quickly drawn to the total which was well over $30,000, FAR ABOVE the $30 to $40 a square foot we were quoted ($30,500 divided by 575 square feet comes to over $53 a square foot). I told Mr. Stewart that we could not afford $30,000 and he said "I can suggest some metal building companies", to which we replied "we already have a quote and it is only $6,000 for a metal garage". He quickly left without saying another word or offering to make things right.

I am extremely disappointed by his behavior, making us wait nearly six weeks then coming in $10,000 (a 50 percent increase over his estimated price) over his original quote, but I am more upset with myself for trusting the man. Stewart and Terravest Custom Homes, LLC, so we believe you should proceed very cautiously before hiring him for any project, particularly one with tens of thousands of dollars on the line.

Home Depot (Lawrence, Kansas) Pulls Bait and Switch on Disabled Vet

We are moving to Lawrence, Kansas after losing my business, our home, and most possessions after the federal government and government contractors retaliated against me, illegally cancelling a $50,000 contract this past January and blacklisting my service-disabled veteran-owned small business because I "BLEW THE WHISTLE" AFTER WITNESSING AND REPORTING FRAUD, WASTE, AND ABUSE ON A GRAND SCALE LAST YEAR.

After being forced to give up our 4,200 square foot lakefront home, we are moving to a 1,000 square foot "fixer-upper" in Lawrence . We desperately need to install new floors in the Lawrence house after years of neglect, so we went to Home Depot (Lawrence, Kansas) to look for flooring.

The salesman, Robert Jenkins, a seemingly nice person of British descent, told us they were having a special on installation ... JUST $399 FOR A WHOLE HOUSE! We could hardly pass up a deal like that, particularly in our present financial situation, so we picked out the flooring we wanted and scheduled a measurement appointment for the next day (8/6/2013 - we were charged $50 that would be refunded upon completion of our order).

I called the day after the measurement, being told that I would receive a call "as soon as the measurements were taken" (which never came), wanting to schedule installation as soon as possible because Robert had told me that installations were running three weeks out and we wanted to have the work done before we move-in.

Here comes the old "Bait and Switch"! I finally got a call at 8:30PM last night (8/7/2013) from a salesman stating that he had my quote. One of the type (of salesman) that love to hear their own voice and cannot listen to save their life, he started rattling off prices for the job that I estimated, based on what I was told in the store on 8/5/2013, at $2,200 after military discount (10%) and taxes.

He said the flooring was actually $300 cheaper than I expected because I had overestimated the square footage by 100, so things were looking good ... UNTIL HE STARTED LISTING THE THINGS WE WERE NOT INFORMED ABOUT IN THE STORE!

He went on: "you're going to need sub-flooring at 25¢ a square foot" ... Hey, wait a minute, nobody ever mentioned having to put in a sub-flooring at the store; he continued: "the installation of the sub-flooring and the quarter-round baseboards are an additional $400" ... baseboards? "Yes, THEY ARE REQUIRED and will cost an additional" ... I tuned-out at that point due to the shock of what I was hearing. When he said "that brings the grand total to $4,500" and change ... What? What happened to the $399 installation? "Oh, your order does not qualify for that special pricing". And I have to pay for baseboards and their installation that I never asked for? "You bet, we do not install flooring without new baseboards". At that point I was so pissed-off that I told him to take his bait and switch tactics and put them where the "SUN DON'T SHINE" in so many words or less.
I called Mr. Jackson this morning (8/8/2013) and told him what happened. He said their was some kind of mistake and that he would sort it out and get back to me shortly, knowing we were on a tight schedule and needed the floor installed BEFORE we move-in next week. Six hours later, Mr. Jackson called me and said "I was able to have the installation reduced to just seven hundred and some odd dollars, so now we are at only $4,000". After asking him why installation WAS NOT $399 as I had been told and to please itemize the bid, he had some information wrong, had to "fix" our estimate, and would get back to me in a few minutes ... THAT WAS OVER TWENTY-FOUR HOURS AGO!

I have been a loyal Home Depot customer for decades, driving past Lowes on dozens of occasions to spend tens of thousands over the past 25 years. The new house, which is over 100 years old, neglected, and in a desperate need of repair, we will likely spend tens of thousands of dollars more in the near future (if we can afford it) AND YOU KNOW WHAT? I WILL NOT BE PASSING BY LOWES ANYMORE!

Lowes also has a 10% discount for military and retirees, so they will be the recipients of my business and hard earned money from now on ... UNLESS ... Home Depot has the integrity to DO THE RIGHT THING and honor the promises made during our initial visit on 8/5/2013, which I highly doubt based on previous experience with large companies who could care less about customers, focusing on short-term greed and profit more than repeat business.

You KNOW why they think they can get away with treating us like shit? Because they do ... ROUTINELY ... and because most people do not have the backbone, the discipline, THE NUTS, to follow through with a commitment ... EVEN IF IT COSTS THEM MONEY ... THEIR SELF-RESPECT ... THEIR DIGNITY ... THEIR INTEGRITY!

That is exactly why the airlines treat us like crap ... THEY KNOW WE ARE GOING TO BUY THE CHEAPEST, MOST CONVENIENT TICKET NO MATTER WHAT THEY DO ... NO MATTER HOW BADLY THEY TREAT US! They act with impunity because they can, because people let them get away with it ... IT IS CALLED Institutional Terrorism and is the reason I started this blog ...

    UPDATE ...

To their credit, Home Depot contacted me shortly after writing this piece, offering to sell me the flooring at the price quoted by the salesman, nearly $2,000 less than they tried to get me to pay. I was quite impressed by their willingness to do the right thing. Unfortunately, they failed to tell me that the flooring was a "special order" and could not be installed until 2-3 weeks after we moved into the house. Being disabled and unable to move the heavy furniture and concerned about placing our furniture outdoors for two days, I had to refuse their offer and asked for a refund which they quickly processed. It was unfortunate that we could not get the new floor we wanted, but Home Depot went above and beyond in their willingness to make me, the customer, happy.

Home Depot has been removed from the HALL OF SHAME and I continue to shop there (unlike Best Buy, Verizon and others who were not willing to satisfy the customer).
